Ontario Land Tribunal Hearing – Kanata Lakes Greenspace

An Ontario Land Tribunal case management conference was held with respect to the ClubLink site on January 14, 2026.  The purpose of this session was to consider a request by ClubLink to finalize the Interim Order of the Tribunal that had been made on March 22, 2022 following the hearing held earlier that year. What follows here is a description of what took place from Tim Marc, the City’s legal counsel.

The matters before the Tribunal in 2022 were an application for a Zoning By-law Amendment and an application for draft plan of subdivision approval subject to conditions.  The Tribunal approved these in principle but withheld its final order pending receipt of the draft Zoning By-law Amendment, draft plan of subdivision and a consolidated list of conditions in accordance with the decision of the Tribunal.

The City and the Kanata Greenspace Protection Coalition did not contest the issuance of an order providing draft plan approval to a plan of subdivision and conditions.  In addition to having to meet the conditions in order to proceed to registration, the draft plan and conditions are subject to the possibility of modification should circumstances warrant.  The City, supported by the Coalition, did submit to the Tribunal that the Zoning By-law Amendment should not be approved at this time as, given the City easements existing on the site and technical concerns with respect to the overland flow for significant stormwater events, changes may be necessary as to where development can take place.  The view of ClubLink was that it had provided to the Tribunal all that was required to have the Zoning By-law Amendment approved.

The Tribunal reserved its decision for issuance at a later date.
